Welcome to Price Hero! These Terms of Service (“Terms”) govern your access to and use of the Price Hero website, web app, and related services (collectively, the “Service”), which are operated by Trendful, Inc. (“Price Hero,” “we,” “our,” or “us”). Please read these Terms carefully before using the Service. By accessing or using Price Hero, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Service.

1. Description of the Services

Price Hero helps users discover estimated resale values for their personal items—such as handbags, watches, and other luxury goods—based on aggregated and condition-adjusted resale data provided by Trendful, our data partner. Once an item is added to a user’s collection, the Service may also display available resale platforms, donation options, and authentication services where users can take further action with their items.

The pricing information shown is for informational purposes only and does not constitute a formal appraisal, financial advice, or an offer to buy or sell any item. We make reasonable efforts to provide accurate and up-to-date information, but values may vary across marketplaces and over time.

2. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
• By using Price Hero, you represent that you have the legal capacity to enter into these Terms.
• If you are using the Service on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

3. Accounts and Communications

You must create an account to view estimated resale values of your items and to add them to your collection. You agree to:

• Provide accurate and complete information,
• Keep your login credentials secure, and
• Promptly update your account details as needed.

By creating an account, you consent to receive transactional and administrative emails about your use of the Service. You may opt out of non-essential marketing emails at any time using the unsubscribe link.

You are responsible for all activity that occurs under your account. Price Hero reserves the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Acceptable Use

You agree to use the Service only for lawful, personal, and non-commercial purposes.

You must not:

• Copy, scrape, or attempt to extract data from Price Hero or its underlying databases,
• Interfere with or disrupt the Service or servers,
• Upload unlawful, harmful, or infringing content, or
• Use the Service in a way that could harm Price Hero or others.

We may suspend or terminate access if we reasonably believe you are violating these rules.

5. Data and Content Ownership and Feedback

All data, software, algorithms, and intellectual property underlying the Service—including the resale data provided by Trendful—belong to Price Hero or its licensors.

You retain ownership of any content you upload (e.g., item photos, descriptions), but by submitting that content, you grant Price Hero a worldwide, non-exclusive, royalty-free license to use, store, display, and analyze it as needed to operate and improve the Service.

Feedback. If you send ideas, suggestions, or improvements, you grant Price Hero a perpetual, irrevocable, worldwide, royalty-free license to use and exploit the Feedback for any purpose without compensation to you.

We may use aggregated or anonymized data to enhance our analytics, develop new features, and support market insights.

6. Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to: DMCA Agent, Trendful, Inc., support@pricehero.ai with: (a) your signature, (b) identification of the work and the allegedly infringing material, (c) contact info, (d) a statement of good-faith belief, and (e) a statement under penalty of perjury that the notice is accurate and you are authorized to act. We may remove content and terminate repeat infringers.

7. Data Retention and Deletion

Retention Period

When you upload or create information on Price Hero, that data is stored to provide the Service and for legitimate business purposes such as analytics, troubleshooting, and improving user experience.

Deleted items appear in your Trash for up to 30 days after deletion. After 30 days, they are hidden from your view but remain in our secure systems for analytical and operational purposes.

Permanent Deletion

Data is not automatically deleted after the 30-day period. We may retain deleted data indefinitely in archived or anonymized form unless you specifically request permanent deletion of your account or associated data, subject to legal and operational requirements.

User Requests

You can request permanent deletion of your account or certain data by contacting support@pricehero.ai. Upon verification, we will remove or anonymize your data within a reasonable time frame, unless retention is required by law or legitimate business need.

Purpose of Retention

We retain deleted and historical data to:

• Maintain security and integrity of the Service,
• Analyze long-term usage and pricing patterns,
• Improve product accuracy and reliability, and
• Enable support teams to recover data if deleted by mistake.

Hidden but Not Lost

After 30 days, deleted data is hidden from user view but remains securely stored. This information is never sold to third parties and is processed only in accordance with our Privacy Policy.

Future Policy Updates

We may update our retention practices in the future and will reflect any changes in this document or our Privacy Policy.

8. Intellectual Property

The Price Hero name, logo, trademarks, and all related intellectual property are owned by Trendful, Inc. or its affiliates. You may not use our trademarks, data, or materials without written permission.

All rights not expressly granted to you are reserved by Price Hero.

9. Disclaimers and Beta Features

Price Hero provides informational estimates only. We do not guarantee the accuracy, completeness, reliability, or suitability of any pricing data or content made available through the Service.

You understand that:

• Price Hero does not buy, sell, or authenticate items.
• Prices shown are estimates and may not reflect actual resale outcomes.
• The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

Beta and Experimental Features. From time to time, we may offer features identified as beta, preview, or experimental. These features are provided “as is,” may contain bugs, and may be modified or discontinued at any time.

Service Availability. We may change, suspend, or discontinue any part of the Service at any time without notice.

10. Free Service, Limitation of Liability, and Indemnification

Price Hero is currently offered as a free service. While no payment is required to use the Service, you acknowledge that access and features may change or be discontinued at any time without notice.

Limitation of Liability. To the maximum extent permitted by law, Price Hero and its affiliates, officers, directors, employees, and licensors will not be liable for any indirect, incidental, consequential, or punitive damages arising from or relating to your use of (or inability to use) the Service. Our total liability for any claim shall not exceed the amount, if any, that you paid to use the Service.

Indemnification. You agree to defend, indemnify, and hold harmless Trendful, Inc. (d/b/a Price Hero), its affiliates, and its officers, directors, employees, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service, your content, or your violation of these Terms.

11. Third-Party Links and Affiliate Disclosure

Price Hero may include links to third-party websites or services. These links are provided for convenience and do not imply endorsement. We are not responsible for the content, terms, or practices of any third-party websites.

Affiliate Disclosure. The Service may display or link to resale marketplaces, donation services, or authentication providers. We may receive referral fees or compensation if you interact with these third parties. We do not control and are not responsible for their products or policies.

Price Hero is currently a free service. If any paid features or subscriptions are introduced in the future, users will be notified in advance, and new payment terms will apply.

12. Governing Law, Waiver of Jury Trial, and Class Action Waiver

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. The parties irrevocably submit to the exclusive jurisdiction and venue of the courts of the State of Florida to resolve any disputes arising in connection with these Terms.

Any claim arising under these Terms shall be brought solely in the United States District Court for the Middle District of Florida, Tampa Division, or the Circuit Court for the Thirteenth Judicial Circuit of Florida, Tampa Division.

Each party waives any right to a trial by jury in any action related to these Terms.

Class Action Waiver. To the fullest extent permitted by law, you and Price Hero agree that each may bring claims only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

13. Dispute Resolution

If a dispute arises out of or relates to these Terms, or their breach, the parties agree to submit the dispute to mediation under the rules of the American Arbitration Association (AAA). If the dispute is not resolved within sixty (60) days of initiating mediation, either party may pursue any legal remedy available.

14. Export Controls and Sanctions

You may not use or access the Service if you are located in, under the control of, or a national/resident of any country, or a person embargoed or sanctioned by the United States. You agree to comply with all applicable U.S. export and re-export restrictions.

15. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, in whole or in part, including in connection with a merger, sale, or corporate reorganization.

16. Force Majeure

We are not liable for any delay or failure to perform due to events beyond our reasonable control, including acts of God, labor disputes, internet outages, or governmental actions.

17. Miscellaneous

Severability. If any provision is unenforceable, the remaining provisions remain in full force.

No Waiver. Any failure to enforce a provision is not a waiver.

Entire Agreement. These Terms constitute the entire agreement between you and us regarding the Service.

Survival. Sections that by their nature should survive termination do survive (including ownership, disclaimers, limitations, and governing law).

Notices. We may provide notices via email, in-product messages, or by posting to the Service.

18. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the date at the top and notify users by posting the revised Terms on our website. Your continued use of Price Hero after changes take effect means you accept the updated Terms.
